of THE SAFFRON STITCH LTD t/a THE SAFFRON STITCH, Unit 1, St John's Barn, Griffin Farm, Conger Lane, Toddington, LU5 6BT

1. General

The following terms and conditions (“Instore Terms and Conditions”) apply to all orders for good and services made in person, instore rather than via the website www.thesaffronstitch.co.uk (“THE SAFFRON STITCH LTD online store”) and are constituted between a customer (“customer” or “you”) and THE SAFFRON STITCH LTD ("THE SAFFRON STITCH", “we” or “us”). By shopping at the THE SAFFRON STITCH instore, you accept these terms and conditions.

2. Orders, Instructions & Pricing

2.1. Presentations of items and requests for services at the THE SAFFRON STITCH instore do not constitute binding offers. Your order is only accepted, and a contract is only concluded, when we notify you by email, text or telephone call that your respective item(s) are ready for collection.

2.2 Because most of the services and products that we provide to you are completed by hand especially for you we may not be able to cancel your order.

2.3 For each garment a description will be prepared by the tailor, recording the customer’s measurements and garment alteration instructions (“the Instructions”) agreed with you.   Upon completion of the work specified it will be quality controlled.      

2.4 Our standard price list has been prepared by way of guideline for basic alterations, and these prices are quoted for standard alterations.

2.5 More complex alterations, including all bridal alterations, are estimated.  In the event that the quoted or estimated cost of alterations is significantly different to the estimated alterations price given at the time of the Instructions, we will inform customers prior to carrying out any work.

3. Completion of alterations

3.1. Alterations are normally completed within seven to ten working days unless otherwise stated, sooner where possible.  Express charges of additional 25% may apply to urgent alterations.  Please ask about express alterations prior to appointment, and any additional cost that may be involved.

3.2. We will do our best to produce your order to the quality you expect in accordance with the Instructions and in the time promised. If we don’t manage that then let us know and we will do whatever we can to help.

3.3 On collection the customer should try on the garment and immediately inspect it thoroughly for any defects.  We cannot accept responsibility for any further or remedial alterations connected to the original work more than 72 hours after payment and collection.

3.3. Our business is based on using our hands and skills to give you a fantastic service and we hope you enjoy shopping with us.

4. Uncollected items and disposal

We will retain un-collected orders for 3 months from the date you place your order.

4.1 After that time we will dispose of the item(s) or donate them to an accredited charity of our choice. We also reserve the right to no longer accept orders from you if you do not collect items which are for payment in-store.

5 Defects and liability for clothes and other items

5.1 THE SAFFRON STITCH. Stitch will take the utmost care of your clothes but all garments left with us are entirely at the owner’s risk. In the very unlikely event that items are lost or damaged compensation is limited to the following:

Repairs & alterations - 10 times our quoted or estimated service charge price;

Specialist items - up to £500 per item.

If you believe the depreciated value of your garment/item exceeds 10 times our service charge, please declare the value.

In which case the garment/item will be serviced at 1/10th of the declared value of the item.

5.2 If a garment is unacceptable to the customer as a result of the alterations not being carried out in accordance with the Instructions, we will rectify the work at our expense.

5.3 If further alteration(s) are required, this additional work will be charged accordingly.

5.4 Any damage must be reported within 72 hours of collection from us by email, phone-call or in person.

5.5 We will pay compensation if found liable following an internal investigation. The compensation offer will be in line with the Fair Compensation Guidelines. (We follow the Textile Services Association (TSA) guidelines drawn up in conjunction with the association of British Insurers).

5.6 The TSA guidelines indicate that fair and reasonable compensation be paid on the basis of an allowance for wear and tear and the age of the Item. It is considered reasonable for Us to ask for receipts, bank or credit card statements confirming the purchase price prior to agreeing any compensation.

5.7 We will follow the TSA guidelines. The compensation given will not include extra costs to purchase the Item, including but not limited to shipping costs, tailoring/altering costs, etc.

5.8 THE SAFFRON STITCH cannot accept liability for any consequential losses outside of our control. For example you needed a suit for an interview and had to buy another before we had sufficient time remedy any issues with your suit.

We will also not be responsible for any loss or damage resulting from the following:

any pre-existing damage to the Item;

any extraneous objects left in or on the Item, including but not limited to: notes, coins, buttons, jewellery, cufflinks, collar stiffeners, pens or tie clips;

any extraneous packaging provided with the Item, including but not limited to: clothes hangers, suit bags or personal laundry bags;

our disposal of Items in accordance with paragraph 5;

any normal wear and tear.

6. Payment

6.1 We accept electronic payments using Tap & Pay or online link via our third-party payment processing provider(s) or by direct online bank transfer. We try to be a cashless business and do not accept any other methods of payment. We do not accept payment by cheque.

7. Collection and use of data

7.1. Personal data which is made known to us in the course of our business relationship with you, e.g. your name and contact details, is saved and used by us solely for the purpose of fulfilling the contract. Occasionally we may, with your consent, take photographs of you in your clothes if this will assist with an alteration. We will not share these pictures with anyone for any reason. Some of your personal data may be passed to us by our payment processing providers (name, address etc). We never have or hold your card or payment details.

7.2. If you no longer consent to your personal data being saved or if the data concerned is no longer correct, we shall, upon receiving a corresponding instruction, arrange for your data to be deleted, amended or blocked within the framework of the statutory provisions.

7.3. You may request us to send you information free of charge concerning all your personal data we have stored. You may withdraw your consent at any time with future effect. Please notify us by e-mailing (hello@thesaffronstitch.co.uk) or send your letter to THE SAFFRON STITCH Unit 1, St John's Barn, Griffin Farm, Conger Lane, Toddington, LU5 6BT, if you wish to do so.

7.4. We often take before, during and after photographs of items we have worked on which we may add to our website or social media. If we alter a wedding dress we will make best endeavours not to publish any photograph before the date of the wedding. Photographs of our own work undertaken to your garments do not constitute personal data. Nevertheless, if you make a request to us to remove such photographs from public view we will do so.

7.5. Further details on data processing, such as what happens when you visit our website, are regulated by our Privacy Policy & Cookie Policy.

8. Defects, Applicable law

8.1. These terms and conditions and all agreements with you are governed by and construed in accordance with the laws of England & Wales. The application of the United Nations Convention of Contracts for the International Sale of Goods is excluded.

8.2. In case of defective goods, the statutory provisions apply.

8.3. In any case, this choice of applicable law shall not have the result of depriving you, the consumer, of the protection afforded to you by provisions that cannot be derogated from by agreement by virtue of the law which, in the absence of choice, would have been applicable.

1. General

The following terms and conditions (“Online Terms and Conditions”) apply to all orders and services in connection with the website www.thesaffronstitch.co.uk (“THE SAFFRON STITCH LTD online store”) constituted between a consumer (“consumer” or “you”) and THE SAFFRON STITCH LTD ("THE SAFFRON STITCH", “we” or “us”). By accessing the THE SAFFRON STITCH online store, or by shopping at the THE SAFFRON STITCH, you accept these terms and conditions.

2. Orders

2.1. Presentations of goods at the THE SAFFRON STITCH online store do not constitute binding offers. By activating the button “BUY NOW” you place an order to THE SAFFRON STITCH to buy goods. When you place an order to purchase goods from THE SAFFRON STITCH, we will subsequently send you an e-mail, which confirms the receipt of your order. This e-mail is only a confirmation that we have received your order. It does not constitute an acceptance of your order. Your order is only accepted, and a contract is only concluded, when we dispatch the respective goods to you and when we have sent an e-mail confirmation to you.

2.2. THE SAFFRON STITCH may refuse to accept your order, particularly if an item is unavailable or if you have failed to pay invoices for previous deliveries. If we do not accept an order we shall inform you. We accept orders only in quantities which correspond to the typical needs of an average household.

2.3. Only consumers older than eighteen years and with a residential address in the United Kingdom may place an order at the THE SAFFRON STITCH online store. THE SAFFRON STITCH will not conclude contracts with customers from other countries unless you make contact first. If you do get in touch and we do contract with you then the rest of these General Terms and Conditions will apply.

2.4. Prices at the THE SAFFRON STITCH online store are indicated in Sterling (GBP). The prices do not include delivery and shipping costs unless this is stated. Delivery and shipping costs do accrue as indicated separately. Care is taken to ensure that the prices you see on the website are correct however, very occasionally, there could be a pricing error. If this happens you will be contacted as soon as is possible to let you know and to offer you the option of reconfirming your order at the correct price or cancelling your order. If we don't get hold of you or you decide that you don't want the order anymore, we will make a refund.

2.5. The minimum order value is £7.50.

2.6. Until finally placing your order by activating the button “BUY NOW”, you may identify and correct input errors at any time. For this purpose, please activate the Button “SHOPPING CART”. Then please check and, if necessary, correct errors by deleting and/or updating your order.

2.7. The language of the contract is English. This means that we only conclude contracts in English language.

2.8. After concluding the contract, we store the text of this agreement. You have no access to such stored agreement, however, on http://www.thesaffronstitch.co.uk/?servicecenter=agb you have access to the applicable Terms and Conditions, as amended from time to time

3. Delivery, shipping costs, cancellation and returns

3.1. Shipping is only possible to countries served by Royal Mail and, where outside the UK, only by prior agreement. (see 2.3)

3.2. The delivery charge for each order will be shown at check-out.

3.3. We usually despatch within 1 – 3 days following confirmation of an order. In certain cases despatch can take up to 7 days.

3.4. If you return goods without a further statement, we will interpret such a return of goods as cancelling the purchase, provided the de minimus price and cancellation deadline as stipulated in Section 4. of these Terms and Conditions are met and that your order is not a bespoke order. Accordingly, you may cancel by returning goods to THE SAFFRON STITCH. Alternatively, you may use the model cancellation form (see 4.4.). In case of cancellation you will have to bear the direct cost of returning the goods.

4. Information concerning the right of canellation

De minimus or bespoke orders

4.1. If your order was for less than £42 or for a custom made item you may not cancel this contract unless the items are defective. (see Exceptions or Refunds). 

Other online orders - Our 14 day Customer Satisfaction Guarantee

4.2. You have the right to cancel this contract within 14 days without giving any reason.

The cancellation period will expire 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.

To exercise the right of cancellation, you should inform us (The Saffron Stitch, Unit 1, St John's Barn, Griffin Farm, Conger Lane, Toddington, LU5 6BT, Telephone: 01525 643510, E-Mail: hello@thesaffronstitch.co.uk) of your decision to cancel this contract by an unequivocal statement (e.g. a letter sent by post or by e-mail). You may use the wording from the attached model cancellation form (see 4.4.), but it is not obligatory.

To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right of cancellation before the cancellation period has expired.

Effects of cancellation

4.3. If you cancel this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to cancel this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us, The Saffron Stitch, Unit 1, St John's Barn, Griffin Farm, Conger Lane, Toddington, LU5 6BT, without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.

You will have to bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than which was necessary to establish the nature, characteristics and functioning of the goods.

5. Payment

5.1. The price for the sale of goods is the price as depicted at the time you placed your order. Accordingly, subsequent change in price has no effect on orders already placed.

5.2. We accept electronic payments via our third-party payment processing provider(s) and, for bespoke orders, by direct online bank transfer. We do not accept any other methods of payment. We do not accept payment by cash or by cheque.

6. Retention of title

All goods shall remain our property until the customer has settled all of its payment obligations towards THE SAFFRON STITCH.
